1. Applicable Terms and Conditions
1.A. Your journey is subject to these Conditions of
Contract, tariffs applicable to fares, and to the rules and
limitations relating to liability established by the Warsaw
Convention as made applicable to non-international carriage
by air by the Air Navigation (Special Provisions) Act No.
55 of 1992.
2. Limits on our Liability
2.A. Our liability is limited to a maximum of:
- US$ 20,000 for each passenger
- US$ 20 per kilo for each passengers
checked baggage
- US$ 400 for each passengers
unchecked baggage
2.B. Our liability shall not exceed the proved damages
and we shall not be liable for indirect or consequential damages.
2.C. Our employees, agents and representatives shall
benefit from any exclusion or limitation of our liability.
3. Baggage
3.A. You may carry 20kgs of checked baggage free of
charge. In addition you may carry one piece of hand luggage
measuring no more than 18"x14"x6"
(46x36x20cm) and weighing no more than 7kgs. Any excess will
be weighed and subject to excess baggage charge, and may at
our discretion be carried on another flight.
3.B. For safety and security reasons we may forbid
the carriage of certain articles in your baggage, such as
firearms, explosives, flammable liquids, radioactive materials,
or any other offensive, irritating, toxic, bio-hazardous or
infectious substances.
3.C. Checked baggage will be delivered to the person
producing the baggage check. Any complaints must be made to
us in writing and:
- within 07 days of receipt in the case of
damage.
- within 21 days of receipt in the case
of delay.
4. Refusal of Carriage
4.A. We may refuse to carry you if the applicable fare
has not been paid.
4.B. We may in the reasonable exercise of our discretion
refuse to carry you or your baggage for safety or security
reasons, or if the flight is full and you do not have space
reserved for you on the flight, or if you present an unauthorized
ticket or one that has been acquired in an unauthorized manner
or if your carriage would present a hazard to yourself or
to passengers, crew or property.
5. Delays and Changes
5.A. We will use our best efforts to carry you and
your baggage with reasonable dispatch. Times shown in timetables
or elsewhere are not guaranteed and form no part of our contract
with you. We may without notice substitute alternate aircraft
and may alter or omit stopping places shown on the Ticket
in case of necessity. Schedules are subject to change without
notice. We assume no responsibility for making connections.
6. Security
6.A. You and your baggage are subject to security checks
required by us and government authorities.
7. Denied Boarding
7.A. Though we use our best efforts to provide seats
for which confirmed reservations exist, seat availability
is not absolutely guaranteed. (Where we cannot provide a seat
we will provide compensation in accordance with applicable
law.)
8. Taxes, Fees, Charges and Surcharges
8.A. The ticket price may include taxes, fees and charges,
which are imposed on or in relation to air transport by government
authorities or airports, and may also include a security and/or
insurance surcharge. You may also be required to pay new taxes,
fees, charges and or surcharges not already collected.
9. Check-in
9.A. The time shown on the flight coupon is the departure
time of the aircraft. Our counters generally open one hour
prior to departure, and you should report to our check in
counters at least by such time unless otherwise specified
by us. If you do not check in at the required check in times,
we may refuse to board you, require you to pay a service fee,
cancel other reservations and/or allocate your seat to someone
else.
10. Validity of Ticket
10.A. Your ticket is not transferable, not refundable
and valid only for the date and time specified.
11. Alternations and Waiver
11.A. No employee, agent or representative of ours
has authority to alter, modify or waive any provisions of
our contract with you.
Definitions
As used in this Conditions of Contract:
We, our, ourselves and us - means SriLankan Airlines Limited.
You, your and yourself - means any person, except members
of the crew, carried or to be carried in an aircraft pursuant
to a ticket. Carriage - is equivalent to transportation.
Electronic Ticket - means the itinerary/receipt issued by
or on behalf of Carrier, the Electronic Coupons and, if applicable,
a boarding document. Ticket - means this passenger ticket
and baggage check, or this itinerary/receipt if applicable,
in the case of an electronic ticket, of which these conditions
and the notices form part. Warsaw Convention - means the Convention
for the Unification of certain rules relating to International
Carriage by Air signed at Warsaw, 12th October 1929, or that
Convention as amended at The Hague, 28th September 1955, whichever
may be applicable.
